These Website Terms of Use (“Terms”) govern access to and use of the FEJ Canada website located at https://fej-canada.ca/ and the information, donation, registration, raffle and other services made available through the website.

By accessing or using the website, you agree to comply with these Terms.

Certain transactions or activities may also be subject to additional terms, including Official Raffle Rules, event conditions or program requirements.

1. About FEJ Canada

FEJ Canada is a registered Canadian charitable organization that supports individuals, families and communities through education, empowerment initiatives, humanitarian assistance and related charitable programs.

  • Provide information about its organization and programs;
  • Accept donations;

2. Acceptance of These Terms

By using this website, submitting information, making a donation, registering for an activity or completing an online transaction, you agree to these Terms and any additional conditions presented in connection with the applicable activity.

If you do not agree with these Terms, you should not use the website to complete a transaction or submit information.

3. Permitted Use

You may use the FEJ Canada website for lawful personal, informational and transactional purposes.

You must not:

  • Use the website for unlawful or fraudulent purposes;
  • Attempt to obtain unauthorized access to the website, accounts or systems;
  • Interfere with the operation or security of the website;

  • Attempt to circumvent security measures;

  • Attempt to manipulate a donation, payment, ticket purchase or raffle;
  • Use automated means to interfere with the availability of raffle tickets;
  • Violate the intellectual-property, privacy or other legal rights of FEJ Canada or another person; or
  • Use the website in a manner that could damage FEJ Canada or interfere with another visitor’s use of the website.

FEJ Canada may restrict access where reasonably necessary to protect the organization, its website, its users or the integrity of a transaction or raffle.

4. Donations

FEJ Canada accepts charitable donations through its website and through other authorized methods.

By submitting a donation, you represent that:

  • You are authorized to use the selected payment method;
  • The information you provide is accurate;
  • The transaction is lawful; and
  • You authorize the applicable payment to FEJ Canada.

Donations are used to further FEJ Canada’s charitable purposes, subject to any designation FEJ Canada has agreed to accept.

Where funds are raised for a particular program or initiative, FEJ Canada will make reasonable efforts to use those funds for that purpose.

If a designated program has been completed, becomes impracticable, or receives more funds than can reasonably be used for the stated purpose, FEJ Canada may apply the funds to a related charitable purpose to the extent permitted by applicable law.

5. Official Donation Receipts

FEJ Canada is a registered Canadian charity.

FEJ Canada may issue official donation receipts for eligible gifts in accordance with applicable Canada Revenue Agency requirements.

The donor is responsible for providing accurate information required for receipting purposes.

An official charitable donation receipt may not be issued where a transaction does not constitute an eligible charitable gift.

Raffle Tickets Are Not Charitable Donations

The purchase of a raffle or lottery ticket provides the purchaser with a chance to win a prize and therefore does not qualify as a charitable gift.

FEJ Canada does not issue official charitable donation receipts for raffle-ticket purchases.

6. Payment Processing

FEJ Canada uses Square to process certain online and in-person payments.

Transactions processed by Square may also be governed by Square’s applicable terms and privacy practices.

FEJ Canada is not responsible for an interruption or processing failure originating solely from Square or another independent payment provider, except to the extent liability cannot legally be excluded.

A transaction is not considered successfully completed until payment has been accepted and the applicable confirmation, receipt or ticket has been generated or issued.

7. Raffles

FEJ Canada may conduct charitable fundraising raffles from time to time.

Raffle tickets may be sold:

  • Online through the FEJ Canada website; and
  • In person through authorized FEJ Canada representatives or authorized sales locations.

Raffles will be conducted subject to applicable Quebec law, regulatory requirements, the applicable licence and the Official Raffle Rules established for each raffle.

8. Official Raffle Rules

Each raffle will have separate Official Raffle Rules.

Depending on the raffle, those rules may specify:

  • Name of the raffle;
  • Applicable licence number;
  • Eligibility requirements;
  • Minimum age;
  • Geographic eligibility;
  • Ticket prices;
  • Available ticket quantities;
  • Purchase limits;
  • Sales opening and closing dates;
  • Draw date and time;
  • Draw location;
  • Prize descriptions;
  • Approximate or stated prize values;
  • Winner-selection procedure;
  • Winner-verification requirements;
  • Winner-notification procedure;
  • Prize-claim requirements;
  • Procedures in the event a winner cannot be contacted;
  • Refund or cancellation rules;
  • Procedures for technical interruptions;
  • Publicity or winner-publication conditions; and
  • Other conditions required by law or the applicable licence.

Anyone purchasing a raffle ticket is responsible for reviewing the Official Raffle Rules before completing the purchase.

If these Website Terms conflict with the Official Raffle Rules for a particular raffle, the Official Raffle Rules will govern with respect to that raffle.

9. Raffle Eligibility

Only individuals who satisfy the eligibility requirements contained in the applicable Official Raffle Rules may purchase or hold a valid raffle entry.

Eligibility requirements may include:

  • Minimum age;
  • Residence or physical-location requirements;
  • Restrictions involving FEJ Canada personnel or persons involved in administering the draw; and
  • Other requirements imposed by law, regulation or the applicable licence.

FEJ Canada may request reasonable evidence of eligibility before awarding a prize.

An ineligible entry may be voided in accordance with the Official Raffle Rules and applicable law.

10. Online Raffle Purchases

For online ticket purchases, the purchaser is responsible for:

  • Providing accurate contact information;
  • Ensuring the purchaser is eligible;
  • Using an authorized payment method;
  • Reviewing the applicable Official Raffle Rules; and
  • Ensuring the email address or other delivery information provided is accurate.

An attempted online purchase does not constitute a valid raffle entry until the transaction has been successfully completed and the applicable ticket or entry has been issued or recorded.

Purchasers should retain their ticket or confirmation information until the raffle has concluded and all prizes have been awarded.

11. In-Person Raffle Purchases

Raffle tickets may also be sold in person by authorized FEJ Canada representatives.

An in-person purchaser is responsible for providing any information reasonably required to register the ticket or contact the purchaser in the event of a win.

The purchaser should retain any physical ticket, receipt or other entry record required under the applicable Official Raffle Rules.

12. Ticket Availability

Raffle tickets may be limited in quantity.

FEJ Canada does not guarantee that tickets will remain available until the advertised closing date.

Sales may close earlier if all authorized tickets have been sold or where required for legal, regulatory, administrative or technical reasons.

13. Raffle Transaction Errors

FEJ Canada may correct, reject, cancel or investigate a transaction where reasonably necessary because of:

  • Payment failure;
  • Duplicate transaction;
  • Technical malfunction;
  • System error;
  • Obvious pricing or ticketing error;
  • Fraud or suspected fraud;
  • Unauthorized use of a payment method;
  • Purchaser ineligibility;
  • Violation of the Official Raffle Rules;
  • Regulatory requirements; or
  • Circumstances affecting the integrity of the raffle.

Any cancellation, replacement or refund will be administered in accordance with the Official Raffle Rules and applicable law.

14. Raffle Ticket Refunds

Except where permitted or required by the applicable Official Raffle Rules or applicable law, completed raffle-ticket purchases are generally final.

No refund will be provided solely because a purchaser later decides not to participate.

Nothing in this section limits any right or remedy that cannot legally be excluded.

15. Winner Selection and Verification

Winners will be selected using the procedure described in the applicable Official Raffle Rules.

A person identified as a potential winner may be required to:

  • Confirm identity;
  • Confirm eligibility;
  • Provide the winning ticket or entry information;
  • Provide information reasonably necessary to award the prize; and
  • Complete documentation required by law or the Official Raffle Rules.

A person is not considered a confirmed winner until FEJ Canada has completed any required verification.

If a potential winner cannot be contacted, does not satisfy the eligibility requirements or does not claim the prize within the required period, the prize will be handled in accordance with the applicable Official Raffle Rules and regulatory requirements.

16. Winner Information

FEJ Canada may publish limited information about raffle winners where permitted by applicable law and disclosed in the Official Raffle Rules.

This may include a winner’s:

  • Name;
  • Municipality or region; and
  • Prize won.

FEJ Canada will not publish unnecessary personal information concerning a winner.

The collection and use of raffle participant information is further governed by FEJ Canada’s Privacy Policy.

17. Program and Event Registration

Certain FEJ Canada programs or events may have:

  • Eligibility requirements;
  • Limited capacity;
  • Application processes;
  • Registration deadlines;
  • Codes of conduct; or
  • Additional participation conditions.

Submitting a registration does not guarantee admission where participation is subject to review, eligibility or available capacity.

FEJ Canada may cancel or modify programs and events where reasonably necessary.

18. Website Information

FEJ Canada makes reasonable efforts to provide accurate and current information.

However, website content may occasionally contain:

  • Typographical errors;
  • Technical errors;
  • Outdated information;
  • Incomplete information; or

Nothing in these Terms excludes warranties, rights or remedies that cannot legally be excluded under applicable Quebec or Canadian law.

To the maximum extent permitted by applicable law, FEJ Canada will not be liable for indirect, incidental, special or consequential losses arising solely from access to or inability to access the website.

This limitation does not apply where liability cannot legally be excluded or limited.

FEJ Canada’s collection, use, communication, retention and protection of personal information are governed by its Privacy Policy.

The Privacy Policy should be reviewed before submitting personal information through the website.

FEJ Canada may update these Terms from time to time to reflect changes to:

Subject to mandatory legal rules concerning jurisdiction, disputes concerning the FEJ Canada website or these Terms will be subject to the jurisdiction of the courts of Quebec.

28. Language

A French-language version of these Terms is available.

Where applicable Quebec law requires the French version of predetermined contractual terms to be provided before another language is selected, FEJ Canada will make the French version available in accordance with those requirements.

An individual who has been provided with the French version may expressly choose to use the English version where permitted by law.

29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
